1. Acceptance of Terms
By accessing or using ISPE Lumen™ (“ISPE Lumen”), ISPE’s AI-powered knowledge assistant, you (“User”) agree to be legally bound by these Terms of Use (“Terms”). If you do not agree, do not use ISPE Lumen. ISPE may update these Terms at any time; continued use constitutes acceptance of any changes.
2. About ISPE Lumen
ISPE Lumen is an AI/LLM assistant trained on ISPE’s Guidance Documents, Pharmaceutical Engineering® magazine, content from ISPE’s website, and other ISPE resources. ISPE Lumen is not a human expert. All responses are non-authoritative and intended for informational and educational purposes only. Users must independently verify information before relying on it for professional, regulatory, or operational decisions.
3. License and Permitted Use
ISPE grants you a non-exclusive, non-transferable, limited license to use ISPE Lumen and its outputs for personal or internal business purposes only. Commercial use, resale, or redistribution of ISPE Lumen or its outputs is prohibited without ISPE’s prior written consent.
4. Intellectual Property
All intellectual property rights in ISPE Lumen and the ISPE content on which it is trained remain the sole property of ISPE or its licensors. You acquire no ownership interest through use of this service. ISPE’s publications and content are protected under U.S. and international copyright law. With respect to all ISPE published and proprietary content, ISPE expressly reserves all rights for text and data mining, AI training, and similar technologies.
You may not reproduce, distribute, or create derivative works from ISPE Lumen outputs without ISPE’s prior written permission. You may not input, or cause to be input, ISPE intellectual property into any third-party AI tool or platform without ISPE’s express written consent.
5. Prohibited Uses
You agree not to use ISPE Lumen to:
- Reverse engineer, decompile, or circumvent any security feature of ISPE Lumen
- Distribute, resell, or sublicense access to ISPE Lumen
- Train or develop competing AI tools using ISPE Lumen outputs
- Submit ISPE copyrighted content to be input into third-party AI tools or platforms
- Interfere with or disrupt ISPE Lumen or ISPE’s underlying infrastructure
- Use automated bots, scrapers, or crawlers to access ISPE Lumen
- Engage in any unlawful, unethical, or unauthorized activity
6. Disclaimer of Warranties
ISPE LUMEN IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ISPE DOES NOT WARRANT THAT ISPE LUMEN WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS OUTPUTS WILL BE ACCURATE, COMPLETE, OR CURRENT. ISPE LUMEN OUTPUTS DO NOT CONSTITUTE PROFESSIONAL, REGULATORY, LEGAL, OR SCIENTIFIC ADVICE.
7. Limitation of Liability and Release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISPE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON ISPE LUMEN. YOU HEREBY RELEASE AND HOLD HARMLESS ISPE FROM ANY AND ALL CLAIMS RELATED TO YOUR USE OF ISPE LUMEN.
8. Indemnification
You agree to defend, indemnify, and hold harmless ISPE and its officers, directors, employees, and agents from any claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of ISPE Lumen, your breach of these Terms, or your violation of any applicable law or third-party rights.
9. Privacy
Your use of ISPE Lumen is subject to ISPE’s Privacy Policy, incorporated herein by reference. Do not submit personally identifiable information (PII) or confidential data into ISPE Lumen. Interactions with ISPE Lumen may be logged and used by ISPE for quality assurance and service improvement in accordance with ISPE’s Privacy Policy.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any dispute arising from these Terms or use of ISPE Lumen shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules in Tampa, Florida. You waive any right to participate in class action proceedings.
11. General
ISPE may suspend or terminate your access to ISPE Lumen at any time without notice. If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force. These Terms, together with ISPE’s Privacy Policy, constitute the entire agreement between you and ISPE regarding your use of ISPE Lumen.
